By flexing its legal muscle, it trampled a business allowing 60 million Napster users to violate the industry's copyrights with the click of a computer mouse.

Wrong. The same flock of 60 million Napster users simply moved to the nearest alternative, heedless of any viruses or spyware associated with them; apparently, loss of Internet privacy is worth the cost of free music.


"Certainly, the rulings from the 9th Circuit and the court remain in effect," said Harvey Dunn, a Dallas-based technology lawyer. "Any third party seeking to emulate Napster is going to face that same case law trying to do something comparable to what Napster was doing."

Apparently, WinMX and others are perfectly legal, as they are still up without a dispute. Which ones have fallen, to date? Any info?


Indeed, Conrad Hilbers, Napster's chief executive, said in a statement Monday that the bankruptcy filing was a legal maneuver to assist it in becoming a legitimate online music service.

I thought it already became a legal service...

The bankruptcy "marks a new beginning for Napster," said Konrad Hilbers, the company's chief executive. "It is clear the demand for an Internet-based music file sharing community that benefits artists and consumers is as strong as ever."

More accurately, "it is clear the demand for a free Internet-based music file sharing community snip is as strong as ever."


While Napster has been in hibernation, the music labels have been building their own online services, pressplay and MusicNet.

All right, someone inform me of what these are? I don't recall them.

These all came out of an old Yahoo! news alert I set up at the start of this whole Napster thing, early in 2001 or so. The news has started to filter in again, so I'll keep updating as I find more.

as far as i know, kazaa, audiogalaxy, and winmx are the 3 leading tools for filesharing, and all have no problem.

ive always wondered if Napster got sued, why does it look like the 3 are legal? oh well...

Audio Galaxy is way better than napster...

let's face it to keep them up and running would be beating a dead horse.

At best I consider them martyrs for the cause.

It started as a program written by a college student, and it turned into a mass of corporate management. That's not a good thing.

I use Gnutella clients for my file sharing.
Not being based in any one country is a good thing in this case. The gnutella network in worldwide and has no base of operations, no one company or person behind it.

Too bad for Napster. Sad thing is, most musicians didn't mind Napster, just a few of them and most of the record companies.

Kazaa is going under.

And as for gnutella, it has been around since the Napster glory days, and nothing can stop it because it's not centralized and it can be used for legitimate purposes. If users want to send MP3's over the network, that's their own can of worms.

The problem with the "pay per download" services? They do not containt all the record labels, and you may not be able to get everything you like!

Audiogalaxy filters copyrighted content and blocks some songs. I jused to like Kazaa, but right now it sucks. I can't get more than 19KBps on it, and I used to be happy with 90. I used to average 120 to 140 on Napster. It's a pity it went down right when I got my DSL. I tried WinMX, but I have NEVER to date successfully downloaded a file off of it. Same with LimeWire and Gnutella clients, they just don't work with me for some reason.
