By flexing its legal muscle, it trampled a business allowing 60 million Napster users to violate the industry's copyrights with the click of a computer mouse.
Wrong. The same flock of 60 million Napster users simply moved to the nearest alternative, heedless of any viruses or spyware associated with them; apparently, loss of Internet privacy is worth the cost of free music.
"Certainly, the rulings from the 9th Circuit and the court remain in effect," said Harvey Dunn, a Dallas-based technology lawyer. "Any third party seeking to emulate Napster is going to face that same case law trying to do something comparable to what Napster was doing."
Apparently, WinMX and others are perfectly legal, as they are still up without a dispute. Which ones have fallen, to date? Any info?
Indeed, Conrad Hilbers, Napster's chief executive, said in a statement Monday that the bankruptcy filing was a legal maneuver to assist it in becoming a legitimate online music service.
I thought it already became a legal service...

More accurately, "it is clear the demand for a free Internet-based music file sharing community snip is as strong as ever."
While Napster has been in hibernation, the music labels have been building their own online services, pressplay and MusicNet.
